I'm not really in a position to lower the rent and would rather re-let the property early.</DIV><DIV>&nbsp;</DIV><DIV>The situation is as follows:</DIV><DIV>&nbsp;</DIV><DIV>We have a fairly standard 12 month live/work tenancy agreement.</DIV><DIV>We are only&nbsp;2 months into the agreement and do not have a 6 month break clause.</DIV><DIV>&nbsp;</DIV><DIV>So far she has been very co-operative and we've managed to come to an agreement wherby:</DIV><DIV>&nbsp;</DIV><DIV>"She can stay in the property until I find someone else. In which case I'd like to give her 4 weeks notice. She can also give me 4 weeks notice to terminate the tenancy agreement early. She will only be liable for rent for the time she uses the property up until she leaves."</DIV><DIV>&nbsp;</DIV><DIV>I don't want to be in a situation where she changes her mind and refuses to leave.&nbsp;We both&nbsp;agreed it would be better to formalise the agreement on paper and so I asked the estate agent who manages the property to draft a document outlining this. They provided us both with copies of a "Rider of Tenancy" to sign, but now she says she doesn't understand the wording and wants me to remove the clause or explain it.</DIV><DIV>&nbsp;</DIV><DIV>I must admit, i'm also a little unclear as to the exact&nbsp;meaning and so am hoping someone here may be able to clear it up a little..&nbsp;The agent says its a standard clause&nbsp;put on all such amendmants.. and that its for my benefit.&nbsp;I&nbsp;probably&nbsp;shouldn't ask&nbsp;her to sign this if I don't really understand it myself?? Or is she being un-reasonable.</DIV><DIV>&nbsp;</DIV><DIV>The Rider clause is as follows:</DIV><DIV>&nbsp;</DIV><DIV>""This rider of Agreement refers to the current tenancy being undertaken and any extension or renewal of that tenancy. All references to the Landlord herein shall be deemed to include the Landlord's Agent or any person authorized to act on the Landlord's behalf.</DIV><DIV>The Tenant shall pay and make good to the Landlord on demand all losses, damages, costs and expenses of the Landlord arising from or incurred as a result of any default by the Tenant in the performance or observance of the Tenant's covenants under the Tenancy Agreement that any neglect or forbearance of the Landlord in endeavouring to obtain payment of the Rent when it falls due and at any time which may be given to the Tenant by the Landlord shall not release or exonerate the Tenant or in any way affect the liability of the Tenant under this deed.""</DIV><DIV>&nbsp;</DIV><DIV>How should I proceed?</DIV><DIV>&nbsp;</DIV><DIV>Many Thanks,</DIV><DIV>&nbsp;</DIV><DIV>&nbsp;</DIV><DIV>&nbsp;</DIV><DIV>&nbsp;</DIV>]]>

I will certainly look into the Credit Check and guarantor thing.<br><br>I'm assuming that as you recommended them, and from your comments that the AST provided at propertyhawk would not need a solicitor to check over it.<br><br>I know letting agents will do this for me, but as i have found my own tenant i would like to avoid the fees if possible. This arrangement should work out for both of us if done correctly.<br><br>P.S There appears to be some code in your post, is that something wrong with my viewing or have you missed some closing tags somewhere?<br>]]>
